TERMS OF SERVICE

01. About Learnest

Learnest is a language-learning service designed to help users build practical language ability through structured learning and active speaking practice.

Features may include:

• CEFR-aligned learning pathways;
• Study mode;
• Move mode;
• Cards;
• speaking and shadowing practice;
• AI Conversation;
• Level Tests;
• My Topics;
• user-created and imported learning material;
• pronunciation and language feedback;
• downloadable lessons for offline learning;
• progress tracking;
• streaks;
• milestones and badges;
• leagues and leaderboards; and
• other learning tools introduced over time.

The exact features available may depend on your subscription, learning language, level, device, region and version of Learnest.

02. Eligibility

You must be at least 13 to use Learnest.

If you are under 18, you should only purchase or start a paid subscription where this is permitted by applicable law, your app-store account and any parent or guardian permission that may be required.

If the law where you live requires additional parental or guardian permission to use an online service of this kind, you must have that permission.

03. Your account

You are responsible for keeping your account secure and for activity carried out using your account.

You must provide information that is accurate to the best of your knowledge and must not impersonate another person.

Depending on the options available, you may create or access your account using Learnest account credentials, Apple Sign-In or Google Sign-In.

You must not allow another person to use your account in a way that compromises its security or Learnest's systems.

04. Learning languages and progress

Learnest may allow you to learn more than one language using the same account.

Language-specific progress may include:

• CEFR level;
• lessons and Topics;
• sentences mastered;
• Level Test results;
• My Topics;
• AI Conversation progress;
• language-specific milestones; and
• learning statistics.

Certain features may operate across the entire account, including an overall streak, league position and some account-level achievements.

Switching learning language does not ordinarily reset progress already achieved in another language.

05. CEFR levels and Level Tests

Learnest uses CEFR-aligned structures to organise learning content and progression.

CEFR levels and Learnest's internal sub-levels are intended to provide a structured learning pathway.

A Learnest Level Test may assess how much of the material within a particular learning level you appear to have retained and whether additional review may be useful.

A Learnest result is an in-app learning indicator. It is not an official language qualification, examination certificate or formal accreditation unless expressly stated otherwise.

06. AI-generated and automated learning content

Learnest uses artificial intelligence and other automated systems as part of the learning experience.

AI-generated sentences, translations, explanations, conversation responses, corrections, pronunciation feedback and other outputs may occasionally be inaccurate, incomplete or unsuitable.

You should treat them as learning tools rather than guaranteed linguistic or factual authority.

AI-generated outputs may not be unique. Other users may receive similar or identical content.

We may update, correct or improve learning content where errors are identified.

07. Speaking, pronunciation and conversation features

Learnest may provide pronunciation practice, speaking exercises, shadowing and AI Conversation.

Speech recognition and pronunciation analysis are automated technologies and may not always accurately interpret speech, accent, dialect or pronunciation.

Feedback and scores are intended to support learning and should not be treated as definitive assessments of a learner's ability.

Availability of particular voices, accents or language variants may change over time.

08. My Topics and imported content

Learnest may allow you to create your own learning Topics and add sentences manually or from material you provide.

You may also be able to upload photographs or other permitted material so that Learnest can extract relevant text and generate learning content.

You remain responsible for ensuring that you have the right to upload and use material you submit.

Learnest may generate translations, sentences, flashcards or other learning material from the content you provide.

You should review generated material before relying on it, particularly where accuracy is important.

09. Your content

You retain your rights in content you submit to Learnest.

By submitting content, you give us limited permission to host, store, process, reproduce and transmit that content where necessary to operate Learnest and provide the features you request.

This permission exists only for purposes connected with operating, securing and providing Learnest and ends when the content is deleted, subject to reasonable backup retention and legal obligations.

You must not submit content that:

• you do not have the right to use or share;
• unlawfully infringes another person's rights;
• is deliberately malicious or unlawful;
• is intended to compromise Learnest or its systems; or
• is otherwise prohibited by applicable law.

10. Learnest-generated content

You may use learning content generated specifically for you through Learnest for lawful personal learning purposes.

AI-generated outputs may not be exclusive to you.

Learnest's branding, software, interfaces, lesson structures, fixed editorial content, audio content and other intellectual property remain owned by or licensed to Learnest and may not be reproduced or commercially exploited without permission.

11. Progress, streaks, badges and leagues

Learnest may provide gamification features including streaks, milestones, badges, points, leagues and leaderboards.

League participation may be enabled automatically following eligible learning activity, but users may be able to opt out of league participation and/or league-related notifications.

League rankings may be based on eligible learning activity completed during a defined period.

Points, rankings, promotion rules, league sizes, badges and other gamification mechanics may be adjusted over time where reasonably necessary to improve fairness, prevent abuse or improve the learning experience.

Gamification features are intended for motivation and entertainment and do not constitute formal assessments of language ability.

12. Premium subscriptions

Learnest may offer paid access through monthly and annual auto-renewing subscriptions.

The exact subscription price will be displayed in your local currency through the Apple App Store or Google Play before you purchase.

Regional prices may differ.

The price displayed by the relevant app store at the time of purchase is the price that applies to your transaction.

Subscriptions provide access to the paid features described in the app at the time of purchase.

13. Free trials

Learnest may offer a free trial before a paid subscription begins.

Where a free trial or another promotional trial is offered, the trial period and price that will apply afterwards will be displayed before you subscribe.

Unless you cancel before the end of the trial in accordance with the relevant app-store rules, the subscription will automatically convert into the monthly or annual paid plan you selected.

Eligibility for trials may be determined by Apple, Google or Learnest.

AI Conversation or other computationally intensive features may be subject to fair-use limits during a free trial.

14. Renewal, cancellation and refunds

Subscriptions automatically renew unless cancelled in accordance with the rules of the Apple App Store or Google Play.

You can manage or cancel your subscription through the relevant app-store subscription settings.

Deleting your Learnest account does not automatically cancel your app-store subscription. You should cancel an active subscription separately if you do not want future renewal charges.

Refund requests are generally handled by Apple or Google where they processed the purchase, subject to their policies and any statutory rights that apply to you.

Nothing in these Terms affects rights that cannot legally be excluded.

15. Downloads and offline learning

Some paid plans may allow learning content to be downloaded for offline use.

Download availability may depend on your subscription status, device, storage capacity and the particular learning content.

Downloaded content is licensed for personal use within Learnest and is not transferred to you as permanently owned content.

Access to downloaded material may change if your subscription ends, the content is updated or technical requirements change.

16. Fair use and usage limits

Some Learnest features use computationally intensive third-party services, including AI Conversation, speech processing, pronunciation analysis, content generation, translation and processing of imported material.

Free users

The Free version of Learnest may include usage limits on certain features. These limits may include, for example:

• AI Conversation;
• photo or content imports;
• AI-generated My Topics material;
• speech or pronunciation processing; and
• other computationally intensive features.

The applicable Free limits will be shown within Learnest where relevant and may be adjusted from time to time.

Premium users

Premium access provides substantially greater access to Learnest features. Where a feature is described as unlimited, this means unlimited normal personal learning use, subject to reasonable fair-use and abuse-prevention protections.

We may apply reasonable usage, rate or fair-use limits where necessary to:

• protect service availability;
• prevent automated, excessive or abusive use;
• maintain security;
• prevent use inconsistent with personal language learning; or
• manage exceptionally high third-party processing usage.

We will not use hidden restrictions to materially misrepresent the subscription purchased.

Where a material usage restriction applies, we will aim to explain it clearly within Learnest or in the relevant subscription information.

17. Notifications

If you choose to enable notifications, Learnest may send learning reminders, streak reminders, progress updates, league information or service-related notifications.

League-related notifications may be separately controllable where the feature allows this.

You can change your notification settings at any time through Learnest or your device.

18. Acceptable use

You must not use Learnest to:

• break the law;
• infringe another person's rights;
• compromise another person's privacy;
• upload material you are not entitled to use;
• distribute malware or malicious code;
• attempt unauthorised access to Learnest or another user's account;
• scrape, reverse engineer or misuse Learnest except where the law expressly permits it;
• manipulate league rankings or learning statistics through automated or artificial activity;
• interfere with the security or operation of the service;
• abuse AI or other resource-intensive functionality through automated or unreasonable use; or
• use Learnest for fraudulent or harmful purposes.

We may restrict or suspend access where reasonably necessary to protect Learnest, its users or third parties.

19. Availability and changes

We aim to provide a reliable service, but we cannot guarantee that Learnest will always be uninterrupted, error-free or available.

We may maintain, update, replace or improve features over time.

Because Learnest relies on technology and third-party services, particular functionality may occasionally be unavailable.

Languages, voices, variants, lessons, AI features and learning tools may be added, modified or removed over time.

We may change features where reasonably necessary, but we will not deliberately remove the core value of a paid subscription without taking appropriate steps for affected users.

20. Third-party services

Learnest relies on selected third-party services, including providers of AI, speech, voice, hosting, authentication, push notifications and app-store payment services.

Their availability may affect the operation of Learnest.

If you use Apple or Google services, their own terms and policies also apply to your relationship with them.

21. Suspension and termination

You may stop using Learnest at any time.

We may suspend or terminate an account where reasonably necessary because of:

• serious or repeated breach of these Terms;
• unlawful activity;
• fraud;
• security threats;
• abuse of Learnest systems;
• manipulation of league or learning systems; or
• circumstances where we are legally required to do so.

Where reasonably possible, we will act proportionately.

22. Account deletion

You can request deletion of your Learnest account through the app.

Deleting your account removes your Learnest account and associated personal data from active systems, subject to the retention described in our Privacy Policy and any information we are legally required to retain.

Account deletion and subscription cancellation are separate processes.

23. Intellectual property

The Learnest name, branding, software, app design, graphics, audio, lesson structures, written content, interfaces and other intellectual property are owned by or licensed to the business providing Learnest.

Except for the personal use permitted by these Terms, nothing grants you ownership of Learnest's intellectual property.

24. Liability

Nothing in these Terms limits or excludes liability where doing so would be unlawful.

Nothing in these Terms affects your mandatory consumer rights.

To the extent permitted by law, Learnest is not responsible for losses that were not reasonably foreseeable when you began using the service.

Learnest is a language-learning service and does not guarantee that using it will result in a particular CEFR level, examination result, fluency level, employment outcome or other specific result.

Learning outcomes vary between users and depend on factors including practice, consistency, previous knowledge and use of the language outside Learnest.

Learnest is provided primarily for personal learning use. We are not responsible for business or commercial losses arising from use of the service except where applicable law requires otherwise.

25. Privacy

Our Privacy Policy explains how personal information is collected, used, stored and shared through Learnest.

Please read it alongside these Terms.

26. Changes to these Terms

We may update these Terms where Learnest, applicable law or our commercial arrangements change.

If a change is material to existing users, we will take reasonable steps to notify you.

Continuing to use Learnest after updated Terms take effect may mean the updated Terms apply to your continued use, subject to applicable consumer law.

27. Governing law

These Terms are governed by the laws of England and Wales.

If you live outside England and Wales, you retain any mandatory consumer protections that apply under the laws of your country of residence.

Nothing in this clause removes rights that cannot legally be excluded.
